Please read these Terms and Conditions ("Terms") carefully before using the XAH website or submitting an inquiry. By accessing the site or contacting us, you agree to be bound by these Terms. If you do not agree, please do not use our services.

These Terms are governed by and should be read alongside our Privacy Policy, Shipping Policy, and Returns & Refunds Policy.

1. Introduction

XAH ("we", "us", "our") operates the showcase catalog at https://luxarastore.com. Availability and logistics are confirmed per inquiry on WhatsApp or Telegram.

These Terms govern your use of our website and your purchase of products from us.

2. Eligibility & Account

You must be at least 18 years of age (or the age of majority in your jurisdiction) to place an order. By using this site you represent that you meet this requirement.

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorised use.

We reserve the right to refuse service, cancel orders, or close accounts at our discretion, including where we have reasonable grounds to believe the Terms have been violated.

3. Products & Pricing

We take care to describe and photograph our products accurately. However, slight variations in colour or appearance may occur due to screen settings, photographic lighting, or natural variation in gemstones and metals. Such variations do not constitute a defect.

All product descriptions clearly state whether stones are natural (mined), lab-created, or simulants. Where applicable, metal purity (e.g. 925 sterling silver, 18k gold vermeil) is listed on the product page.

Prices are displayed in USD unless otherwise indicated. We reserve the right to alter prices at any time. The price applicable to your order is the price displayed at the time of checkout.

We are not responsible for currency conversion losses or bank charges applied by your card issuer.

4. Orders & Payment

An order placed on our website is an offer to purchase. A binding contract is formed only when we send you an order confirmation email confirming dispatch. We reserve the right to reject or cancel any order before dispatch — for example, if a product is out of stock, if a pricing error has occurred, or if we suspect fraud.

We accept the following payment methods: major credit and debit cards (Visa, Mastercard, American Express, Discover), PayPal, and select cryptocurrencies (Bitcoin, Ethereum, USDT). All card transactions are processed securely by our payment partners — we do not store card details.

Payment must be received in full before an order is dispatched.

5. Shipping & Delivery

Insured international shipping is arranged after your inquiry is confirmed. Transit estimates of 5–15 business days after dispatch are detailed in our Shipping Policy. Estimates are guidelines only — actual transit time depends on your carrier and customs. We are not liable for delays caused by customs authorities, carrier disruptions, or events outside our control.

Title and risk of loss for products pass to you upon delivery to the address provided at checkout. If a package is returned to us due to an incorrect address provided by you, re-delivery charges may apply.

6. Returns, Refunds & Exchanges

Our full returns policy is set out in our Returns & Refunds Policy. In summary:

  • Eligible items may be returned within 30 days of delivery, unworn and in original condition.
  • Personalised, engraved, or final-sale items are non-returnable unless defective.
  • Refunds are processed to your original payment method within 5–10 business days of receiving and inspecting the return.
  • Return shipping costs are the customer's responsibility for change-of-mind or sizing returns. We cover return shipping when the item is defective, damaged due to our packaging, or not as described.

Nothing in this section limits statutory rights that cannot be waived under applicable law.

7. EU Consumer Rights

If you are a consumer resident in the European Union, the following apply in addition to our standard policies:

  • Right of Withdrawal: Under EU Directive 2011/83/EU, you have the right to withdraw from a distance contract within 14 calendar days of receiving your order, without giving any reason. The 14-day period begins the day after you (or a third party you designate) receive the goods.
  • To exercise this right, notify us via our Contact page on WhatsApp or Telegram before the deadline. You may use the EU model withdrawal form, but it is not mandatory.
  • We will reimburse all payments received from you, including standard delivery costs, within 14 days of receiving your withdrawal notice — provided we have received the returned goods or you have supplied evidence of having sent them back.
  • You bear the direct cost of returning goods unless we agree otherwise.
  • Conformity: Goods must conform to the contract. Where a product is defective upon delivery, you have legal remedies under EU Directive 2019/771 (Sale of Goods Directive), including repair, replacement, or refund.
  • Customs & VAT: Prices are shown exclusive of import duties and local taxes. VAT/sales tax is not automatically calculated at checkout. Import duties, VAT/GST, or brokerage fees may be collected by your local customs authority or carrier upon delivery.
  • Alternative Dispute Resolution: EU consumers may use the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr. Contact us via our Contact page.

8. UK Consumer Rights & Post-Brexit Terms

If you are a consumer resident in the United Kingdom, the following apply:

  • Statutory Rights: Your statutory rights under the Consumer Rights Act 2015 are not affected by these Terms. Goods must be of satisfactory quality, fit for purpose, and as described. If goods are faulty within 30 days of delivery, you are entitled to a full refund. For faults arising within 6 months, we will repair or replace the item; after 6 months the burden of proof shifts to you.
  • Right to Cancel: Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have a 14-day cooling-off period to cancel a distance contract, beginning the day after delivery. Exceptions apply to bespoke or personalised items.
  • Post-Brexit Customs: Since the UK left the EU Single Market on 1 January 2021, orders dispatched from outside the UK may be subject to UK import duty and VAT collected by Royal Mail or the carrier upon delivery. These charges are determined by HM Revenue & Customs and are outside our control. We declare accurate commercial values on all customs documentation. We do not reimburse import charges except where goods are returned due to our error.
  • Northern Ireland: Where relevant, goods sold to Northern Ireland are subject to the Windsor Framework and EU single market rules for goods. Customers in Northern Ireland may benefit from EU consumer protections set out in Section 7 above.
  • Dispute Resolution: UK consumers may contact the Citizens Advice consumer helpline (0808 223 1133) or refer disputes to an ADR scheme approved by the Chartered Trading Standards Institute. We will cooperate with any such process.
  • Governing Law: For UK consumers, these Terms and any dispute arising from them are governed by the laws of England and Wales, without prejudice to any mandatory consumer protections applicable in your country of residence.

9. US Consumer Rights

  • California Residents: Under the California Consumer Privacy Act (CCPA), California residents have rights regarding personal data. Please see our Privacy Policy for details.
  • FTC Compliance: Our product descriptions, customer reviews, and promotional claims comply with FTC guidelines. We do not endorse misleading claims about the therapeutic or healing properties of gemstones.
  • Sales Tax: We do not automatically calculate or collect US state sales tax or EU VAT at checkout. Any import duties or local taxes are typically assessed by customs or your carrier on delivery, unless otherwise required by law.
  • Implied Warranties: To the fullest extent permitted under applicable US state law, we disclaim all implied warranties except as expressly stated herein. Some states do not allow the exclusion of implied warranties, so this may not apply to you.

10. Intellectual Property

All content on this website — including but not limited to product photography, text, design elements, logos, trademarks, graphics, and the overall look and feel — is the exclusive property of XAH or its licensors and is protected by applicable copyright, trademark, and intellectual property laws internationally.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from our site without our prior written consent, except that you may:

  • Print or download a reasonable number of pages for your own personal, non-commercial use;
  • Share links to our pages via social media, provided you do not suggest endorsement or affiliation.

The XAH name and logo are trademarks. You may not use them in connection with any product or service without our prior written approval.

If you believe any content on our site infringes your intellectual property rights, please contact us via our Contact page on WhatsApp or Telegram.

11. Limitation of Liability

To the fullest extent permitted by applicable law, XAH's total liability to you for any claim arising from your use of the site or our services shall not exceed the amount you paid for the specific order giving rise to the claim, if any.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of data, or loss of profit, even if we have been advised of the possibility of such damages.

Nothing in these Terms limits or excludes our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any breach of your statutory consumer rights; or (d) any other liability that cannot lawfully be excluded.

We do not warrant that this website will be uninterrupted, error-free, or free of viruses. We recommend maintaining appropriate security software on your device.

12. Dispute Resolution

We want to resolve any concerns quickly and fairly. If you have a complaint, please contact us first — we aim to respond within 5 business days.

Informal Resolution: Most issues can be resolved informally. Please provide your order number, a description of the issue, and your preferred outcome.

Mediation: If we cannot reach agreement within 30 days, either party may propose non-binding mediation before a mutually agreed mediator.

Binding Arbitration (US customers): For disputes not resolved informally, US customers agree that any claim shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Class actions and class arbitrations are waived to the fullest extent permitted by law. Arbitration shall take place in the state where you reside. You may opt out of arbitration within 30 days of your first purchase by contacting us via our Contact page with the subject line "Arbitration Opt-Out".

EU ODR Platform: EU consumers may use the European Commission ODR platform at ec.europa.eu/consumers/odr.

UK ADR: UK consumers may use a certified ADR scheme. Details available on request.

Small Claims: Nothing in this section prevents you from bringing a claim in a small claims court or tribunal of competent jurisdiction.

13. Governing Law

Unless mandatory consumer law in your country of residence provides otherwise:

  • US customers: These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles.
  • EU customers: These Terms are governed by applicable EU consumer law and the law of the country in which you are habitually resident.
  • UK customers: These Terms are governed by the laws of England and Wales.
  • All other customers: These Terms are governed by the laws of Delaware, USA.

In all cases, mandatory consumer protection provisions of your country of residence take precedence over any conflicting choice of law.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified via a prominent notice on our website or by email to registered account holders at least 14 days before taking effect. Continued use of our services after changes take effect constitutes acceptance of the revised Terms.
